While most states designate different misdemeanor crimes as separate classes, West Virginia operates on a crime-by-crime basis. For instance, assault and battery without serious injury may be considered a Class A Misdemeanor in some state, which means that the penalty can include up to a year in county jail and a fine of up to $5,000. In West Virginia, however, the crime would result in penalties agreed on by state lawmakers. However, the general breakdown for misdemeanor penalties include:

CLASS 1: Up to 12 months in county jail and a possible fine of up to $2,500.

CLASS 2: Up to six months in county jail and a possible fine of up to $1,000.
